DUI / DWI Defense
The breathalyzer said over the limit. That doesn't make it accurate — or admissible.
A DUI Arrest Is Not a Conviction
Most people assume a positive breathalyzer reading means the case is over. It isn't. There are multiple ways a DUI charge can be challenged — from the legality of the initial traffic stop to the calibration records of the testing device to the conduct of the arresting officer during the field sobriety test.
I have successfully challenged DUI charges at every stage. I know how to subpoena breathalyzer maintenance logs, challenge the officer's credentials to administer field sobriety tests, and attack the chain of custody for blood samples.
